Article 2 - Applicability

These general terms and conditions apply to every offer from the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.

By placing an order you indicate that you agree to the delivery and payment conditions. The entrepreneur reserves the right to change his delivery and/or payment conditions.

Article 3 - The offer

The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to enable a good assessment of the offer by the consumer.

Obvious mistakes or errors in the offer do not bind the entrepreneur.

Article 4 - The agreement

The agreement is concluded at the moment of acceptance by the consumer of the offer and compliance with the conditions set.

If the consumer has accepted the offer electronically, the entrepreneur will immediately confirm receipt of the acceptance of the offer electronically.

Article 5 - Right of withdrawal

Digital products: When purchasing digital content, the consumer has the option to terminate the agreement without giving reasons within fourteen days. However, once the digital content has been delivered (download made available), the right of withdrawal expires if the consumer has expressly agreed to this.

Physical products (prints): Since all prints are custom made with your personal image, this is a personalized product. Pursuant to Article 6:230p sub f of the Dutch Civil Code, the right of withdrawal is excluded for products that are manufactured to the consumer's specifications or that are clearly intended for a specific person.

In the event of damage during transport, we will of course take responsibility and provide a suitable solution.

Article 6 - The price

The prices shown are in US dollars. No US sales tax is collected at this time.

All prices are subject to printing and typographical errors. No liability is accepted for the consequences of printing and typographical errors.

Article 7 - Payment

Payment is made via the available payment methods on the website, including credit card, PayPal, and Klarna. The consumer has the obligation to immediately report any inaccuracies in payment details provided or stated to the entrepreneur.

Article 8 - Delivery

Digital products: After successful payment, the digital file will be immediately made available via a download link.

Physical products: The entrepreneur will exercise the utmost care when receiving and executing orders for products. Delivery times are indicative and are usually 2-5 business days. Standard US shipping is $11 below $75 and free for orders of $75 or more. Express shipping is an additional $20.

Article 9 - Intellectual property

The AI-generated images become the property of the customer after purchase. The customer may use this for personal purposes. The entrepreneur reserves the right to use anonymous samples for marketing purposes, unless the customer objects to this.

Article 10 - Privacy

The entrepreneur respects the privacy of all users of its site and ensures that the personal information you provide is treated confidentially. Uploaded photos will only be used to generate your artwork and will not be kept longer than necessary.

Article 11 - Complaints procedure

Complaints about the execution of the agreement must be submitted fully and clearly described to the entrepreneur via support@paintyourfamily.com within a reasonable time after the consumer has discovered the defects.

We will handle complaints as quickly as possible and at the latest within 5 working days. If a complaint requires a foreseeably longer processing time, the consumer will receive a confirmation of receipt within this period and an indication when a substantive answer will follow.

If our complaint handling does not lead to a solution, the consumer can register the dispute for mediation via ValuedShops. If mediation does not lead to a solution, the dispute can be submitted to the independent DigiDispuut dispute committee. The decision is binding on both parties.

Article 12 - Liability

The entrepreneur is not liable for damage resulting from incorrect or incomplete information provided by the consumer, or for damage resulting from the use of the delivered products.

The entrepreneur accepts liability for damage that occurs during transport. If damaged during shipping, we will provide a free replacement.

The liability of the entrepreneur is in all cases limited to the amount that the consumer has paid for the product in question.

Article 13 - Applicable law

All agreements between the entrepreneur and the consumer to which these general terms and conditions apply are exclusively governed by Dutch law.
